Student scientific conferences on constitutional justice. International Conference "Actual Problems of Constitutional Law Theme Conference on Constitutional Law

On October 7-8, 2011, the International Conference "Actual Conditions of Constitutional Law" was held at the Law Faculty of Moscow State University, organized on the initiative of the Faculty NSO with the support of the Department of Constitutional and Municipal Law; criminal proceedings, justice and prosecutor's supervision; Criminalistics.

At the solemn opening of the conference, the Deputy Dean of Research, Professor N.V. Kozlov, Assistant Dean for educational work E.N. Veretko, Member of the International Tax Association A.A. Timonin, Representative of the Garant company G.A. Mardanova and representative of the company "Consultant Plus" V.V. Popova.

The conference worked three sections:

  • "Realization of the constitutional personal rights in the criminal and civil procedure" (under the leadership of the Associate Professor of the Department of Criminal Procedure, Justice and Prosecutorial Supervision, D.P. Chekulaev, Assistant Department of Criminalistics E.S. Kryukov, graduate student of the Department of Criminal Procedure, Justice and Prosecutor's Supervision, Chairman of the NSO Law Faculty of Moscow State University MV Lomonosov, Public Assistant Investigator SC RF A. Trefilova),
  • "Actual problems of Russian federalism" (under the leadership of a member of the International Tax Association MA Timonina),
  • "Actual problems of the activities of state and municipal authorities" (under the leadership of the head of the Department of Constitutional and Municipal Law, Doctor of Law, Professor S.A. Avakyan, Expert D. Salikhova).

Upon completion of the sectional meetings, a teleconference was held with the Samara State University, then parliamentary debates were held on constitutional law.

At the conference, more than 50 students from 15 universities were made, including: Moscow State University named after M.V. Lomonosova, Kiev National University named after Taras Shevchenko, National Law Academy of Ukraine, Belarusian State University, Moscow University of the Ministry of Internal Affairs of the Russian Federation, St. Petersburg State University, St. Petersburg Law Institute (branch) of the Academy of the Prosecutor General's Office of the Russian Federation, Russian Academy Justice, Russian New University, Russian Legal Academy of the Ministry of Justice of the Russian Federation, Chelyabinsk Law Institute of the Ministry of Internal Affairs of Russia, Russian State social University, Kurgan State University, Voronezh State University.

In the evening, the guests were invited to a tour of the Red Square and the Sparrow Mountains, which A. Trefilov held. At the end of the walk took place a festive salute.

In the current year, a new discipline "Constitutional justice" appeared in the curriculum of the International Legal Faculty, which students of the 3rd course of undergraduate in the second semester. Interest, which has shown students to a new subject, and their desire to understand the nuances of the topic prompted the club of political and legal research to hold together with the Department of Constitutional Law Student Scientific Conferences of the General Directivity of "Constitutional Justice".

The following form was selected for carrying out: the wishing-potential participants were offered one general topic, within which it was assumed to discuss all possible aspects of the issue.

The first such conference took place on May 18 and was devoted to the discussion of the topic "Constitutional Court: a negative or positive legislator?".
The topic of the second conference (May 19) was indicated as follows: "Judicial activism in the activities of constitutional justice."

In both cases, the Moderators were the teachers of the Department of Constitutional Law, K.A. Polyvchenko and V.B. Chernoletsky, and among those who wanted to perform students of 1-3 courses of the International Legal Faculty and Faculty of International Relations. The more interesting it was on the interfaculty level to discuss problems - different approaches, different points Vision! Not the listing of all the issues considered, but only the mention of some already shows the breadth of scope and discussion.

The first conference was considered as theoretical issues, for example, the "Legal Positions of the Constitutional Court as a Legal Phenomenon", "the constitutional justice authorities in the post-Soviet space as subjects of the formation of law", "The Constitutional Court in the role of the legislator: the creation of the Constitutional Courts of its own authority in the field of judicial supervision" And quite specific, according to various countries: Constitutional courts of Austria, Spain, the Baltic countries, Bosnia and Herzegovina.

Performances and further scientific discussion on May 18 made it possible to conclude: the constitutional justice body at the present stage acquires a fundamentally new status. As a "negative legislator", he receives the characteristic features of the "legislator of positive", qualitatively affecting its legal positions on the constitutional legislation of the relevant state.

The second conference was no less bright and interesting. Started from discussing points of view on judicial activism, the methodology for evaluating the judicial activism, the doctrine of judicial activism in the United States and continued in the practical plane: "Judicial activism of constitutional courts in a democratic state", "Activism and originality in the activities of the US Supreme Court", judicial activism in Latin America, Baltic, France, in Turkey, Armenia, Russian Federation. Some of the speeches, for example, "" iconic "cases against Ukraine through the prism of the doctrine of judicial activism" caused a stormy discussion that it was decided to continue later.

In general, the discussion during the conference on the topic of judicial activism made it possible to conclude that the current trend shows a special role of judges in making the most important decisions relating to the prospects for the development of the constitutional system of the state. Constitutional courts are increasingly showing signs of high aropaga, designed to ensure total protection of rights and freedoms of both individual and collective.
