Each state municipal institution is entered into a specialized list of organizations, which are assigned the registration number of the GMU organization. From the first day of the current year, sub-clause entered into force. "A" clause 19 of Art. 6 of Law No. 83-FZ, which amended Art. 32 of Law No. 7-FZ "On Non-Commercial Organizations", obliging state and municipal institutions to ensure the openness and accessibility of their constituent documents, certificates of state registration, decisions on the establishment of an institution, decisions on the appointment of a head, provisions on branches and representative offices, state (municipal) assignments, plans for financial and economic activities, annual financial statements, reports on the results of activities and the use of property, information on the control activities carried out.

To implement this provision of Law No. 7-FZ, the Ministry of Finance of the Russian Federation adopted an order dated July 21, 2011 No. 86n "On approving the procedure for providing information by a state (municipal) institution, posting it on the official website on the Internet and maintaining the specified site" which specified that this information should be posted on the official website for posting information about institutions www.bus.gov.ru (hereinafter referred to as the official website). The Federal Treasury was appointed responsible for ensuring the operation of the official website.

According to this order, the institution must provide information to the official website independently or through its authorized representative in two forms: in the form of electronic copies of the documents listed above, and in the form of structured information about its activities. The latter is grouped into sections: general information about the institution, information about the state (municipal) task, about the plan of financial and economic activities, about operations with targeted funds, about budgetary obligations and their implementation (estimate), about the results of activities and the use of property, control measures and annual financial statements. State institutions must post information about themselves on the website if they approve a state (municipal) task.

At the same time, it is important that the reporting indicators and performance indicators in accordance with the order of the Federal Treasury dated December 29, 2011 No. 645 "On approval of requirements for the procedure for the formation of structured information about an institution and electronic copies of documents posted on the official website on the Internet" will be posted on the official website starting September 1, 2012. Now we are talking only about posting on the official website general information about the institution, about state (municipal) tasks, plans for financial and economic activities and budgetary obligations of state institutions, which approved the state (municipal) task.

What is important for an institution to know when posting information

The structure for providing information to the site, provided for by order No. 86n, complies with federal regulations, in particular, the RF Government decree of September 2, 2010 No. 671 "On the procedure for the formation of a state assignment in relation to federal state institutions and financial support for the implementation of a state assignment" and Order of the Ministry of Finance of the Russian Federation of July 28, 2010 No. 81n "On requirements for the plan of financial and economic activities of a state (municipal) institution", and may differ from the structure of documents established by regulatory legal acts of a constituent entity of the Russian Federation or a municipal formation. In this case, the institution will have to compare the indicators of its own documents with the indicators necessary for posting on the site.

Information about the activities of the institution can be posted on the official website both by the institution itself and by its authorized representative (by power of attorney). The representative of the institution can be both a financial body and an executive authority (local government), performing the functions and powers of the founder of this institution.

Entering information on the official website can be carried out either manually through a personal account or in an automated manner. If an automated system operates in a constituent entity of the Russian Federation (municipal formation), which contains up-to-date information about institutions, state (municipal) tasks, plans for financial and economic activities, then this information can be uploaded to the official website in a structured form in accordance with the formats approved by Federal Treasury and posted on the website of the Ministry of Finance of the Russian Federation.

The posted information must be signed with the digital signature of the institution or its authorized representative. In the second case, it is necessary to understand that the authorized representative assumes responsibility for the accuracy of all submitted documents, including their electronic copies, which, in our opinion, is not always possible. We believe that the best option may be for the authorized representative to provide all the information he has on the official website in a structured form and then sign the information by the institution with its EDS, since, according to the law, it is the institution that is responsible for the provision and placement of such information.

As for electronic copies of documents that must be submitted by the institution to the official website, the order of the Federal Treasury No. 645 defines a fairly wide list of formats that can be used to post information. At the same time, there is no requirement for the placement of scanned copies of documents - it is enough for the institution (authorized representative) to submit an electronic copy of the document and sign it with its EDS, which will mean its authenticity.

What EDS to sign documents? It is no secret that at the moment the institution has several EDS for different purposes. To certify the information posted on the official website, the institution can use the EDS issued to the authorized persons of the institution to certify information about placing orders for the supply of goods, performing work, rendering services (on the All-Russian official website for placing information on placing orders - OOS). The EDS will have to be updated by representatives of those institutions whose official name or other significant parameters have changed.

According to Order No. 86n, the formation of structured information about an institution should be carried out using the classifiers, registers and reference books provided for by the legislation of the Russian Federation. And here, special attention should be paid to the list (directory) of organizations. Order of the Federal Treasury No. 645 provides for the maintenance of a register of organizations in the public administration sector (hereinafter - ROSGU), which must contain all relevant information about the institution. Responsibility for providing (updating) information about the institution in accordance with order No. 645 currently lies with the institution or its representative. The order specifies in detail the procedure for providing information about the institution to the Federal Treasury body at the location of the organization in the form of an application for amendments to ROSGU. Updating information about the institution in ROSGU is extremely important, since in the absence of data about the institution in the register, information about its activities cannot be posted on the official website.

For users to work with the site, by order of the Federal Treasury No. 645, the minimum requirements for the software installed on the user's computer, necessary for posting information, were determined. In the list of these requirements, you need to pay attention to the need for the specialist who signs the EDS information to have Crypto Pro cryptographic protection means.

Integration with the official website of the CA of the constituent entities of the Russian Federation and Moscow region

To facilitate the posting on the official website of information about institutions, the Department of Information Technologies in the field of state and municipal finance management and information support of the budgetary process of the Ministry of Finance of the Russian Federation in October 2011 created a pilot group to test the official website, which included the Amur Region, the Perm Territory, Republic of Tatarstan, Omsk region, Chuvash Republic. The Ministry of Finance of the Russian Federation also invited IT companies operating in pilot regions to cooperate.

The first task set for the developers by the Ministry of Finance of the Russian Federation in the framework of the pilot testing was the analysis of the software operating at the customers for the completeness of the information contained in it and the necessary revision. The result of this stage was the expansion of the capabilities of the automated systems of the constituent entities of the Russian Federation and municipalities to ensure that they maintain the necessary information (mostly general information about the institution) and the subsequent entry by users of the details of institutions and performance indicators that were previously absent in them. The organization of work to supplement the systems with the necessary information in a short time has become the most significant problem that the pilot subjects have to face at the moment.

The official website was launched on December 27, 2011. At the first stage, it became possible to manually post information about the institution through a personal account. The next step was the ability to transfer general information about the institution in a structured form to the official website. There was even competition between the regions and the developers of automated systems - who would be the first to upload information to the site. Our company and the Amur Region became the winner of this small competition. In February, we are faced with a more serious task - to organize a massive automated submission of information on state (municipal) tasks and plans for financial and economic activities in pilot regions to the site, and from March 1 - for all other regions of the Russian Federation.

Unified State Register of Legal Entities - the basic classifier for the formation of the register of organizations

When creating the official website, the Ministry of Finance of the Russian Federation immediately outlined the task of applying uniform classifiers and registers, including the register of public sector organizations, by all participants in the budget process. Proceeding from the fact that the body registering all changes in the status of legal entities is the Federal Tax Service, the Ministry of Finance of the Russian Federation announced a decision that the Unified State Register of Legal Entities (Unified State Register of Legal Entities) classifier will become the basis for the formation of general information on institutions on the official website. However, in order for the current content of the ROSGU classifier of the Federal Treasury to be replaced by the content of the Unified State Register of Legal Entities, it is necessary to ensure the relevance of the data available in the databases of the Federal Tax Service.

To solve this problem, the Ministry of Finance of the Russian Federation instructed the Federal Tax Service and the financial authorities of the constituent entities of the Russian Federation to organize a centralized reconciliation of data for each region, taking into account the clarifications sent by the letter of the Ministry of Finance of the Russian Federation dated November 25, 2011 No. 18-05-05 / 1048.

Based on the experience of the Amur Region, together with which our company participated in this project, we can say that the greatest problem in solving the task was the need for multiple reconciliation of data on institutions during the period of their mass re-registration, associated with both a change in their legal status (government, new budgetary, autonomous), and with the transfer of municipal health care institutions to the regional level.

At the moment, work on updating the Unified State Register of Legal Entities continues. Upon completion of this work, the Ministry of Finance of the Russian Federation may decide to use the Unified State Register of Legal Entities as the base classifier of the official website. In this case, the principle of "one window" will begin to operate for institutions - any information about the institution should first appear in the Federal Tax Service and only then on the official website and in other information systems for managing public finances.
