The register of federal state information systems (GIS), which is maintained by everyone's beloved Roskomnazdor, and in which state structures are required to register their more or less serious (but not secret) information systems, is small. I have long wanted to dig deeper into it and take a closer look at what the systems are and on what they work, making the life of an ordinary citizen even easier and happier every day. Especially when every day the federal media happily report on the success of import substitution in all sectors of the national economy, including in the IT sector, and large Western vendors are beginning to turn their backs on Russian government customers.

The register is posted on the Roskomnadzor website, where there is a section with open data sets - great! Downloading the latest archive of the Registry dated February 16, 2016, inside is an xml-download from September 2015 ... Nice try, citizen. We'll have to supplement the "open data" with fresh information directly from the site, where everything has been done to make it difficult for enemies to parse the Registry. As a result, as of March 8, 2016, we got a list of 339 federal state information systems, some entertaining infographics on which I want to present to you.

For each GIS, the Registry can indicate several supported OS and DBMS at once, so it is impossible to understand what kind of software it works with in reality. Therefore, in the next three diagrams for such systems, the plus sign was put into several categories at once.

1. Distribution by supported server OS

Of the domestic developments, only the mysterious Zircon operating system based on Solaris, AltLunux and MSVS is mentioned.

2. Distribution by supported client OS

It is not clear what exactly several applicants mean by "Mobile operating system" at once.

3. Used DBMS

From the DBMS, only Red Database (based on Firebird), IRBIS64 and LINTER-VS can be considered domestic developments (in the comments to the publication, the author is objected: "1C: Database" can also be considered a domestic OS - ed.).

Apparently, in order not to be late, as always, the Russian Post prescribed July 2016 as the date of commissioning for its GIS of housing and communal services. This is the only GIS from the future.

Seven information systems account for half of all spent funds (amounts are indicated in thousands of rubles):

The sad irony is that the lion's share of the money was spent on some mythical things - the first and second places are taken by GAS "Vybory" and "Justice" with a minimal gap. The honorable third place goes to the automated system of the Ministry of Internal Affairs with the self-explanatory name IBD-F. This mighty three GIS accounts for more than a quarter of all expenses indicated in the Register - 61 billion rubles.

Concept

In December 2011, the Concept on accounting for state information systems was approved.

According to the concept, by the end of April 2012, the accounting system was to be created and put into trial operation.

As of June 2012, the register of software of federal government agencies does exist, it contains information on 239 systems. Among the departments that submitted the data were the Ministry of Agriculture, the Accounts Chamber, Rosreestr, the Ministry of Foreign Affairs, Rosstat and a number of others.

In the current version of the information disclosure portal, one could see the name of the person responsible for the operation of the infamous alcohol accounting system (EGAIS) at Rosalkogolregulirovanie, brief descriptions of the equipment and databases involved, development and operation costs in 2010. There are currently no amounts for 2011.

Government decree

In June 2012, Prime Minister Dmitry Medvedev signed a decree on accounting for information systems created in the interests of federal agencies and off-budget funds.

In the document, the government gives two groups of instructions: to the project coordinator - the Ministry of Telecom and Mass Communications and the federal government agencies themselves, which must enter information into the accounting system.

The Ministry of Telecom and Mass Communications should give instructions on accounting and classification of software and infrastructure components by the end of August 2012, develop forms of electronic passports and rules for compiling unique identifiers for software and equipment. In addition, the ministry should write the rules for submitting data to the accounting system and a methodology for assessing the effectiveness of work.

Federal agencies are given a month more time - until the end of September. Before that time, they must select a person responsible for publishing the data and formally describe how such disclosure will proceed. The status of the person responsible for filling the accounting system, as in the case of interdepartmental interaction, must not be lower than the deputy head. After that, within a month, i.e. by the end of November at the latest, all data on the software operating in the department should be in the accounting system.

As a result, it will be possible to read information about the working software, the costs of it and the effectiveness of projects on the website 365.minsvyaz.ru, as well as on the single portal of the budget system budget.gov.ru (now only a test page is available).

The appendix to the current government decree determines the set of published data and the promptness of updating the single database. The deadline for putting the accounting of information systems into commercial operation was defined in the concept - the end of 2012.

The widespread concept of "system" can be defined as a set of interrelated and interacting elements, united into a single whole, possessing properties that are absent in its elements.

As an ordered set of elements, the system possesses the properties of divisibility and integrity.

Divisibility means that the system can be represented as consisting of relatively independent parts - subsystems, each of which can be considered as a system. The ability to separate subsystems (decomposition of the system) simplifies its analysis, development, implementation and operation. Allocation (decomposition) of subsystems is a rather difficult task.

Integrity property indicates the consistency of the purpose of the functioning of the entire system with the objectives of the functioning of its subsystems and elements.

Since the functioning of the majority of systems created and used in the field of legal activity is based on information processes - the processes of collecting, processing, accumulating, storing, searching and distributing information, such systems are called information systems.

An information system can be viewed as "a means of providing communication between people in the form of questions and answers, while overcoming the barriers of time and space through the transmission, processing and storage of information." 1

Article 2 of Federal Law No. 149-FZ of July 27, 2006 provides the following definition: “information system is a set of information contained in databases and information technologies and technical means ensuring its processing”.

Any computer system that can process, store and transform data is an information system.

The main functions of the information system are collection, storage, accumulation, search and transmission of data used in the management, planning and organization of production.

The organizational and legal forms of information systems are very diverse: they are libraries, archives, information funds, depositories, banks and databases, information services (centers, institutes, bureaus, etc.) of various levels and scales. The functions of information systems are optimized with the development and improvement of the corresponding means - software, hardware, linguistic, regulatory, and organizational. These tools include: computer programs; computer facilities and communications; dictionaries, thesauri and classifiers; instructions and guidelines; regulations and statutes; schemes and their descriptions, etc.

Thus, the components of the information system are:

    a person and his activities aimed at solving certain problems;

    information that is the subject of this activity 2;

    means and methods (technical, mathematical, linguistic) used to transform information into forms that ensure the adoption of the necessary decision.

The process of data processing in information systems is impossible without the use of technical means, which include a computer, input-output devices, office equipment, communication lines, network equipment.

Information processing software consists of software and documentation required to operate these programs. These primarily include universal software tools for creating and processing documents: text editors, spreadsheets and database management systems (DBMS).

In the designated Law, Articles 13 and 14 are devoted to information systems. Article 13 of the Law introduces a classification of information systems depending on the entity creating the information system.

First of all, stand out state information systems, which are created on the basis of federal laws, laws of the constituent entities of the Russian Federation, on the basis of legal acts of state bodies. State information systems, depending on the level of the bodies that created them, can be federal or regional.

Stand out municipal information systems, which can be created on the basis of a decision of the local government.

The law also provides for the creation other information systems, not included in the previous two groups.

Information systems and technologies using computer technology and communication are implemented in accordance with the standards in force in the Russian Federation and international standards.

Information systems, technologies, means of their support, as well as software and hardware means of information protection, are subject to certification in the cases and in the manner provided for by the legislation of the Russian Federation.

Features of the operation of state and municipal information systems can be determined, among other things, by technical regulations.

Federal Law of December 27, 2002 No. 184-FZ "On Technical Regulation" regulates relations arising:

    in the development, acceptance, application and implementation of mandatory requirements for products, production processes, operation, storage, transportation, sale and disposal;

    when developing, accepting, applying and fulfilling, on a voluntary basis, requirements for products, processes of production, operation, storage, transportation, sale and disposal, performance of work or provision of services;

    in conformity assessment.

Technical regulations- a document that is adopted by an international treaty of the Russian Federation, ratified in the manner prescribed by the legislation of the Russian Federation, or by a federal law, or by a decree of the President of the Russian Federation, or by a decree of the Government of the Russian Federation, and establishes the mandatory requirements for the application and implementation of technical regulation objects (products, including buildings, buildings and structures, production processes, operation, storage, transportation, sale and disposal).

Technical regulation is carried out in accordance with the principles:

    application of uniform rules for establishing requirements for products, production processes, operation, storage, transportation, sale and disposal, performance of work or provision of services;

    compliance of technical regulation with the level of development of the national economy, development of the material and technical base, as well as the level of scientific and technological development;

    independence of accreditation bodies, certification bodies from manufacturers, sellers, executors and purchasers;

    a unified system and rules for accreditation;

    the unity of the rules and methods of research (testing) and measurements when carrying out mandatory conformity assessment procedures;

    uniform application of the requirements of technical regulations, regardless of the types or characteristics of transactions;

    inadmissibility of restricting competition in the implementation of accreditation and certification;

    inadmissibility of combining the powers of the state control (supervision) body and the certification body;

    inadmissibility of combining by one body the powers for accreditation and certification;

    inadmissibility of off-budget financing of state control (supervision) over compliance with the requirements of technical regulations.

Technical regulations are adopted in order to:

    protecting the life or health of citizens, property of individuals or legal entities, state or municipal property;

    protection of the environment, life or health of animals and plants;

    prevention of actions misleading purchasers.

The adoption of technical regulations for other purposes is not allowed.

Standardization is carried out in order:

    increasing the level of safety of life or health of citizens, property of individuals or legal entities, state or municipal property, environmental safety, safety of life or health of animals and plants and promoting compliance with the requirements of technical regulations;

    increasing the level of safety of facilities, taking into account the risk of natural and man-made emergencies;

    ensuring scientific and technological progress;

    increasing the competitiveness of products, works, services;

    rational use of resources;

    technical and informational compatibility;

    comparability of research (test) and measurement results, technical and economic and statistical data;

    interchangeability of products.

Compliance is confirmed in order to:

    certification of the conformity of products, production processes, operation, storage, transportation, sale and disposal, works, services or other objects with technical regulations, standards, terms of contracts;

    assistance to buyers in a competent choice of products, works, services;

    increasing the competitiveness of products, works, services in the Russian and international markets;

    creating conditions for ensuring the free movement of goods across the territory of the Russian Federation, as well as for the implementation of international economic, scientific and technical cooperation and international trade.

For violation of the requirements of technical regulations, the manufacturer (performer, seller, person performing the functions of a foreign manufacturer) is liable in accordance with the legislation of the Russian Federation, and if he becomes aware of the non-compliance of products released into circulation with the requirements of technical regulations, he is obliged to report this to the appropriate state control body ( supervision) within ten days from the receipt of the named information.

Information owner's rights information system contained in the databases are subject to protection regardless of copyright and other rights to such databases.

The requirements established by the Law for state information systems apply to municipal information systems, unless otherwise provided by the legislation of the Russian Federation on local self-government.

Features of the operation of state information systems and municipal information systems can be established in accordance with technical regulations, regulatory legal acts of state bodies, regulatory legal acts of local government bodies that make decisions on the creation of such information systems.

The procedure for the creation and operation of information systems that are not state information systems or municipal information systems is determined by the operators of such information systems in accordance with the requirements established by the designated law or other federal laws.

The goals of creating state information systems include:

    implementation of the powers of state bodies;

    exchange of information between government agencies;

    other goals established by federal laws.

Decree of the Government of the Russian Federation of August 15, 2003 No. 500 approved the Regulation on the federal information fund of technical regulations and standards and a unified information system for technical regulation.

The federal information fund of technical regulations and standards is an organizationally ordered set of documents in the field of technical regulation and is a state information resource.

Such a fund is created on the basis of the federal fund of state standards, all-Russian classifiers of technical and economic information, international (regional) standards, rules, norms and recommendations for standardization, national standards of foreign countries in order to ensure compliance of technical regulation with the interests of the national economy, the state and development of material technical base, the level of scientific and technological development, as well as providing stakeholders with information in the field of technical regulation.

The Federal Information Fund of Technical Regulations and Standards is created and maintained by the Federal Agency for Technical Regulation and Metrology, which interacts with federal executive authorities, business entities, public associations, international and foreign organizations for technical regulation, standardization, metrology and assessment in maintaining the said fund. compliance.

A unified information system for technical regulation is created in order to provide interested parties with information about the documents that are part of the federal information fund of technical regulations and standards, as well as regulatory documents on conformity assessment and metrology.

This is a public information system, which includes arrays of documents in the form of official publications and in electronic digital form, a reference and retrieval apparatus and relevant information technologies. It also includes a referral service that enforces the provisions of the Agreement on Technical Barriers to Trade and the Agreement on the Application of Sanitary and Phytosanitary Measures of the WTO regarding information on technical regulations, standards and conformity assessment procedures.

The creation and operation of a unified information system for technical regulation is provided by the Federal Agency for Technical Regulation and Metrology, interacting with the federal executive authorities.

State information systems are created taking into account the requirements stipulated by the Federal Law of July 21, 2005 No. 94-FZ "On placing orders for the supply of goods, performance of work, provision of services for state and municipal needs." This Law regulates relations related to the placement of orders for the supply of goods, the performance of work, the provision of services for state or municipal needs, including establishing a unified procedure for placing orders, in order to ensure the unity of the economic space on the territory of the Russian Federation when placing orders, the effective use of funds budgets and extra-budgetary sources of financing, expanding opportunities for the participation of individuals and legal entities in placing orders and stimulating such participation, developing fair competition, improving the activities of state authorities and local governments in placing orders, ensuring publicity and transparency of placing orders, preventing corruption and others abuse in this area.

State needs are understood as the needs of the Russian Federation for goods, works, services necessary for the implementation of its functions (including for the implementation of federal target programs), for the fulfillment of international obligations, including for the implementation of interstate target programs in which the Russian Federation participates (hereinafter also referred to as federal needs), or the needs of the constituent entities of the Russian Federation for goods, works, services necessary to perform the functions of constituent entities of the Russian Federation, including including for the implementation of regional target programs.

Government customers and municipal customers can be, respectively, the state authorities of the Russian Federation or its subjects and local self-government bodies, as well as recipients of budget funds authorized by these bodies to place orders when placing orders for the supply of goods, performance of work, provision of services at the expense of budget funds.

The customer or the authorized body (if such a right is provided for by the decision on the creation of the authorized body) has the right to attract a legal entity (specialized organization) on the basis of an agreement to perform the functions of placing an order by holding a tender in the form of a tender for the right to conclude a state or municipal contract or an auction for the right to conclude a state or municipal contract - the development of tender documentation, auction documentation, publication and placement of a notice of an open tender or an open auction, sending invitations to participate in a closed tender or in a closed auction and other functions related to ensuring the conduct of tenders. At the same time, the creation of a commission for placing an order, determination of the initial price of a state or municipal contract, the subject and essential conditions of a state or municipal contract, approval of its draft, tender documentation, auction documentation, determination of bidding conditions and their change are carried out by the customer, an authorized body, and signing state or municipal contract - by the customer.

The specialized organization is chosen by the customer, the authorized body by holding an auction in accordance with the Federal Law.

When placing an order by holding a tender, auction, as well as requesting price quotations for goods, works, services (request for quotations), a competitive, auction or quotation commission is created.

Participants in the placement of orders are persons applying for the conclusion of a state or municipal contract. Any legal entity, regardless of the organizational and legal form, form of ownership, location and place of origin of capital, or any individual, including an individual entrepreneur, can be a participant in the placement of an order.

A state or municipal contract is understood as an agreement concluded by the customer on behalf of the Russian Federation, its constituent entity or municipal formation in order to meet state or municipal needs.

The government of the Russian Federation, the supreme executive body of state power of its constituent entity, and the local administration determine the official print publication for publishing information on placing orders, as well as the official website of the Russian Federation, the official website of its constituent entity, the official website of the municipality on the Internet for posting information on placing orders.

The basis for the creation and operation of state information systems is statistical and other documented information.

By the Decree of the State Committee of the Russian Federation on Statistics (now the Federal State Statistics Service) of July 15, 2002 No. 154, the Regulation on the procedure for submitting statistical information necessary for conducting state statistical observations was approved.

The Regulation regulates the procedure for submitting statistical information necessary for conducting state statistical observations by legal entities, their branches and representative offices, citizens engaged in entrepreneurial activities without forming a legal entity (reporting entities).

State statistical observation is carried out by collecting information from the reporting subjects (primary statistical data on the forms of state statistical observation (state statistical reporting) in the form of documented information) in order to form consolidated official statistical information on the socio-economic and demographic situation of the country.

Official statistical information, which is part of state information resources on the socio-economic and demographic situation of the country, is formed in accordance with the federal program of statistical work, annually developed by the Goskomstat of Russia on the basis of proposals from federal executive bodies, executive bodies of the constituent entities of the Russian Federation and other users of statistical information, and submitted to the Government of the Russian Federation.

The federal executive authorities responsible for the implementation of the federal program of statistical work, and their territorial bodies, upon revealing the facts of violation of the procedure for submitting statistical information necessary for conducting state statistical observations, submitting inaccurate statistical information, may, if necessary, submit proposals to the Goskomstat of Russia and its territorial bodies. on bringing violators to administrative responsibility.

In accordance with Art. 13.19 of the Code of Administrative Offenses of the Russian Federation, violation by the official responsible for the provision of statistical information of these conditions shall entail the imposition of an administrative fine in the amount of thirty to fifty times the minimum wage.

Statistical information provided by legal entities, their branches and representative offices, citizens engaged in entrepreneurial activities without forming a legal entity, for conducting state statistical observations, depending on the nature of the information contained in it, may be open and public or classified in accordance with the legislation to the category of limited access ...

Lists of the types of information that is provided without fail are established by federal laws, and the conditions for its provision - by the Government of the Russian Federation.

For example, in accordance with the Federal Law of April 25, 2002 No. 40-FZ "On Compulsory Insurance of Civil Liability of Vehicle Owners", executive authorities of the Russian Federation, constituent entities of the Russian Federation, local governments, organizations and professional association the information they have (including confidential) related to insured events under compulsory insurance or events that served as the basis for the victims' claims for compensation payments.

The internal affairs bodies also provide insurers, upon their requests, with information on the registration of vehicles with the owners of which these insurers have concluded compulsory insurance contracts.

Insurers and their professional association are obliged to comply with the protection regimes established by the legislation of the Russian Federation, the processing of the received confidential information and the procedure for its use, and in case of their violation, they are liable under the legislation of the Russian Federation.

Insurers are obliged to report information about concluded, extended, invalid and terminated compulsory insurance contracts to the internal affairs bodies.

The procedure for providing information is established by the internal affairs bodies of the Russian Federation in agreement with the federal executive body for supervision of insurance activities.

In order to organize the exchange of information on compulsory insurance and control its implementation, an automated information system is being created containing information about compulsory insurance contracts, insured events, vehicles and their owners, statistical and other information on compulsory insurance. Such information refers to federal information resources, the use of which is free and publicly available, with the exception of restricted information in accordance with Federal Law.

The use of restricted information is carried out by state authorities, insurers and their professional associations, other bodies and organizations in accordance with their competence, established by the legislation of the Russian Federation, and in the manner prescribed by them.

Lists of information provided on a mandatory basis by state authorities, insurers, and other persons for the formation of information resources of an automated information system, the procedure for providing users with the information contained in it, as well as bodies and organizations responsible for the collection and processing of these information resources, are approved by the Government of the Russian Federation ...

Unless otherwise established by the decision on the creation of a state information system, the functions of its operator are carried out by the customer who has entered into a state contract for the creation of such an information system. In this case, the commissioning of the state information system is carried out in the manner prescribed by the specified customer.

The Government of the Russian Federation has the right to establish mandatory requirements for the procedure for commissioning certain state information systems.

The operation of the state information system is not allowed without proper registration of the rights to use its components, which are objects of intellectual property.

Technical means intended for processing information contained in state information systems, including software and hardware and information security means, must comply with the requirements of the legislation of the Russian Federation on technical regulation. The requirements are established by the Federal Law "On Technical Regulation".

Information contained in state information systems, as well as other information and documents at the disposal of state bodies, are state information resources.

The means designed to optimize one or another type of legal activity are information and legal systems, among which the following can be noted:

    reference legal systems (ATP) containing legal acts;

    databases for special purposes (accounting of vehicles, information on fingerprinting, etc.);

    expert systems;

    automated training systems (computer business games, tests in legal disciplines, etc.).

Since the ability to quickly navigate in an avalanche of legal acts is an important condition for any professional legal activity, reference and legal systems are of the greatest importance among all information and legal systems.
